Terms of Service

Effective date: May 10, 2026

Welcome to BarBrief. These Terms of Service ("Terms") govern your access to and use of the BarBrief website (barbrief.co and any successor domain), our email newsletters, and any related services (collectively, the "Service"). By creating an account or paying for a subscription, you agree to these Terms. If you do not agree, do not use the Service.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and share personal information.

1. Who we are

BarBrief is operated by [ENTITY NAME, e.g., Claudius Insights LLC], a [STATE] limited liability company ("BarBrief," "we," "us"). You can reach us at alex@barbrief.co.

2. What BarBrief is

BarBrief is a paid email newsletter service that delivers daily California Bar Examination ("CBX") study material. The Service includes rule summaries, original practice questions, analysis of past California State Bar essay prompts and Performance Tests, and selected answers from candidates who passed prior administrations of the California Bar.

BarBrief is educational content. It is not legal advice and does not create an attorney-client relationship. We do not guarantee that any subscriber will pass the California Bar Examination or any other examination. The Service is a study aid only and is not a substitute for a complete bar preparation course or for advice from licensed counsel.

You should not rely on BarBrief as a complete statement of the law, as a substitute for a commercial bar preparation program, or as a guarantee of exam performance. Bar exam rules, formats, grading practices, and tested subjects may change.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By signing up, you represent that you meet these requirements.

4. Subscription, trial, and billing

Plans. BarBrief currently offers two subscription tiers:

Free trial. New subscribers receive a 7-day free trial. You will not be charged during the trial. We will email you a reminder before the trial ends. If you do not cancel before the trial concludes, your subscription will automatically convert to a paid subscription and your payment method will be charged the applicable monthly rate.

Renewal. Paid subscriptions automatically renew each month on the same day until cancelled. By starting a paid subscription, you authorize us (through our payment processor, Stripe) to charge your payment method on a recurring basis until you cancel.

Taxes. All prices displayed are in US dollars and are exclusive of any applicable sales tax, value-added tax (VAT), goods and services tax (GST), or other transaction taxes. Depending on your billing location and applicable law, taxes may be added to your subscription charges and collected by us (through Stripe) at the time of payment. You are responsible for any taxes not collected by us that are owed under your local law.

Cancellation. You may cancel at any time through the Stripe Customer Portal (linked from any BarBrief email), by replying "cancel" to any BarBrief email, or by emailing alex@barbrief.co. Cancellation requests must be submitted before the next renewal charge to avoid that charge. Cancellation takes effect at the end of your current billing period; you will retain access to the Service until then.

Failed payment. If your payment method fails, we will mark your account as past-due and may attempt to retry the charge. If the failure is not resolved within a reasonable period, we may suspend or terminate access to the Service. You remain responsible for any unpaid amounts incurred before suspension or cancellation.

Money-back guarantee. If you are not satisfied with BarBrief, you may request a full refund of your first paid month within 21 days of the first charge. Together with the 7-day trial, this gives you approximately one month of risk-free use. To request a refund, email alex@barbrief.co within the 21-day window. If we issue a refund under this guarantee, we may terminate your paid access immediately upon refund unless we state otherwise. Refunds beyond the first paid month are at our discretion.

Price changes. We may change our prices from time to time. We will give you at least 30 days' notice by email before any price increase takes effect. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

5. Your account and conduct

You are responsible for keeping your contact email and payment information accurate. You are also responsible for ensuring that BarBrief emails are not blocked by spam filters and that your email address remains current. We are not responsible for failure to receive emails caused by your email provider, spam settings, or incorrect account information.

You agree not to:

We may suspend or terminate your account for violations of these Terms. We will issue a prorated refund for any unused paid period if we terminate your account, except where the termination is for fraud, abuse, or violation of law.

6. Content and intellectual property

Our content. BarBrief's original content — including rule summaries, practice questions, model answers, comparative analysis, Performance Test walkthroughs, and the design and code of the Service — is owned by BarBrief and protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to access and use the content for your personal, non-commercial bar exam preparation only.

Source materials. Some content may reference, summarize, quote from, or analyze materials made publicly available by the State Bar of California, including past California Bar Examination essay prompts, Performance Tests, and selected answers. We do not claim ownership of those underlying materials, which remain subject to the rights, terms, and notices of their respective owners.

No NCBE materials. BarBrief does not reproduce or distribute Multistate Bar Examination ("MBE") questions or other materials copyrighted by the National Conference of Bar Examiners.

7. Third-party services

The Service relies on third-party providers for hosting, payment processing, email delivery, database storage, and content generation. These providers include but are not limited to Stripe (payments), Resend (email delivery), Supabase (database hosting), Vercel (web hosting), and Anthropic (AI-generated content). We are not responsible for outages, errors, or failures of these third-party services that are outside our reasonable control.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT WILL BE ACCURATE OR COMPLETE.

The California Bar Examination format, scope, subjects, grading standards, and administrative rules may change. We do not guarantee that any content will reflect the most recent exam changes unless expressly stated.

BarBrief is not affiliated with the State Bar of California, the Committee of Bar Examiners, or the National Conference of Bar Examiners. We do not represent that the Service will result in passing the California Bar Examination or any other exam.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARBRIEF AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable consumer protection law.

10. Indemnification

You agree to indemnify and hold harmless BarBrief from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service or violation of these Terms.

11. Governing law and disputes

These Terms are governed by the laws of the State of [STATE], without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in [COUNTY, STATE], and you consent to the personal jurisdiction of those courts.

Nothing in this Section limits your right to bring claims in small claims court where available, or your rights under any non-waivable consumer protection laws of your jurisdiction.

12. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will notify you by email or through the Service at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
